Welcome to KOVAT Chat. By accessing or using our service, you agree to be bound by these Terms and Conditions. If you do not agree, do not use KOVAT Chat.

1. Definitions

"KOVAT Chat" — the messaging platform operated by Redwolf Productions, accessible at kovatai.com.
"User" — any person who creates an account or uses KOVAT Chat.
"Fangs" — the virtual currency used within KOVAT Chat.
"DPS" — the Digital Policing System, our AI-assisted content moderation system.

2. Eligibility

You must be at least 16 years of age to use KOVAT Chat, in compliance with the Australian Online Safety Amendment (Social Media Minimum Age) Act 2024. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to request age verification and suspend accounts that cannot verify eligibility.

3. Account Responsibility

You are solely responsible for maintaining the security and confidentiality of your account credentials. KOVAT Chat is not liable for any loss or damage arising from your failure to protect your account. This includes, but is not limited to:

Unauthorized access resulting from weak or compromised passwords
Sharing your account credentials with third parties
Failure to enable Two-Factor Authentication (2FA) when available
Loss of encryption keys resulting in permanent inability to decrypt your messages

KOVAT Chat employs end-to-end encryption. We do not have access to your private encryption keys. If you lose your encryption keys, your encrypted messages become permanently inaccessible — we cannot recover them for you.

4. Acceptable Use

You agree NOT to use KOVAT Chat to:

Harass, bully, intimidate, or threaten any person
Share hate speech or content that attacks protected characteristics
Distribute sexually explicit, pornographic, or inappropriate content
Share content depicting or promoting violence, self-harm, or illegal activities
Send unsolicited commercial messages (spam) or operate scams
Impersonate other individuals, organizations, or KOVAT staff
Upload malware, viruses, or malicious code
Violate any applicable Australian federal, state, or territory laws
Attempt to bypass or undermine KOVAT's security or encryption systems
Use automated tools (bots, scrapers) without explicit written permission

5. Content Moderation & Digital Policing System (DPS)

KOVAT Chat employs an AI-assisted Digital Policing System to monitor reported content. When a user or chat is reported:

Alleged violating content may be frozen as evidence and made temporarily inaccessible
An AI analysis is performed to assess the severity and validity of the report
Administrators have the final authority to review, uphold, or overturn DPS decisions

KOVAT Chat cooperates with Australian law enforcement and regulatory bodies as required by law, including compliance with the Online Safety Act 2021 (Cth) and lawful requests from the eSafety Commissioner.

6. Account Suspension & Termination

KOVAT Chat reserves the right, at its sole discretion, to:

Suspend or permanently ban any account that violates these Terms
Delete accounts that have been inactive for 12 months or that pose a security risk
Fine Fangs (deduct virtual currency) from accounts found to have violated platform policies
Remove content that violates these Terms or applicable laws
Restrict features including messaging, calls, or marketplace access

Banned users forfeit all Fangs, purchased items, and account data. No refunds will be issued for banned accounts. KOVAT Chat is not obligated to provide reasons for moderation decisions, though we generally will.

7. Virtual Currency (Fangs)

Fangs are a virtual currency with no real-world monetary value. They cannot be exchanged for real currency, goods, or services outside KOVAT Chat. KOVAT Chat reserves the right to:

Adjust Fang balances for moderation, fraud prevention, or system correction
Modify the Fang economy, pricing, and earning rates at any time
Remove Fangs from accounts that obtained them through exploits or violations

8. Privacy & Data

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms. Key points:

Messages are end-to-end encrypted — KOVAT Chat cannot read them
We store encrypted message data for up to 90 days for service delivery
We comply with the Privacy Act 1988 (Cth) and Australian Privacy Principles
You may request data export or account deletion at any time

9. Intellectual Property

KOVAT Chat, its branding (including the name, logo, and "Redwolf Productions" mark), and all original code, design, and content are the intellectual property of Redwolf Productions. Users retain ownership of content they create and share, but grant KOVAT Chat a limited license to display and transmit that content within the platform.

10. Limitation of Liability

To the fullest extent permitted by Australian law:

KOVAT Chat is provided "as is" without warranties of any kind, express or implied
We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for user-generated content, the conduct of other users, or third-party links
Our total liability for any claim is limited to the amount you paid us (if any) in the 12 months preceding the claim
We are not liable for damages resulting from your failure to secure your account or encryption keys

Some Australian Consumer Law guarantees cannot be excluded. These Terms do not override any rights you have under the Australian Consumer Law that cannot be excluded.

11. Indemnification

You agree to indemnify and hold harmless KOVAT Chat, Redwolf Productions, and its operators from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Third-Party Services

KOVAT Chat may link to or integrate with third-party services (booking platforms, maps, transport services). We do not endorse, control, or assume responsibility for these services. Your use of third-party services is at your own risk and subject to their respective terms.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via in-app notification or email. Continued use of KOVAT Chat after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.
